Tourism Ambassador

Introduction

Welcome to the Visit Africa Tourism Ambassador/Affiliate Program. These Terms and Conditions (“Terms”) govern your participation in our Affiliate Program operated by Architect Tourism SMC Ltd. (“Visit Africa,” “we,” “our,” or “us”). By signing up as a Tourism Ambassador/Affiliate (“Ambassador,” “Affiliate,” “you,” or “your”), you agree to comply with these Terms. Please read them carefully to understand your rights and obligations.

Program Overview

Visit Africa’s Affiliate Program is designed to reward our Ambassadors for promoting our safaris and tourism services. By sharing your unique referral links, you can earn commissions on bookings made through your referrals.

Eligibility

1. Minimum Age: You must be at least 18 years old to participate in the Affiliate Program.
2. Application: Complete and submit the Affiliate Program application form. We reserve the right to accept or reject any application at our discretion.
3. Compliance: You must comply with all applicable laws and these Terms.

Enrollment and Account

1. Account Creation: Upon acceptance into the program, you will be provided with an Affiliate account and a unique referral link.
2. Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities under your account.

Commission Structure

1. Commission Rate: You will earn a commission on qualifying bookings made through your referral link. The commission rate will be specified in your Affiliate account.
2. Qualifying Bookings: A booking qualifies for a commission if it is completed and paid for through the Visit Africa website using your referral link.
3. Payment: Commissions will be paid out on a monthly basis, provided the minimum payout threshold is met. Payments will be made via the payment method specified in your account settings.

Marketing and Promotion

1. Permissible Promotion: You may promote Visit Africa on your website, social media platforms, email, and other approved channels.
2. Prohibited Activities: You must not:
   • Use false or misleading statements about Visit Africa.
   • Engage in unsolicited spam or bulk email campaigns.
   • Use pay-per-click advertising using keywords that include Visit Africa’s trademarks.
   • Misrepresent your relationship with Visit Africa.
3. Content Approval: All promotional content must adhere to Visit Africa’s branding guidelines and may be subject to review and approval.

Intellectual Property

1. License: Visit Africa grants you a non-exclusive, non-transferable, revocable license to use our trademarks and promotional materials solely for the purpose of promoting our services under these Terms.
2. Restrictions: You must not modify, adapt, or create derivative works from our trademarks or promotional materials without prior written consent.

Termination

1. Voluntary Termination: You may terminate your participation in the Affiliate Program at any time by providing written notice to Visit Africa.
2. Involuntary Termination: Visit Africa reserves the right to terminate your participation in the Affiliate Program immediately for any reason, including but not limited to breach of these Terms, inactivity, or fraudulent activity.
3. Effect of Termination: Upon termination, you will cease using all promotional materials and referral links. Commissions earned prior to termination will be paid out in accordance with these Terms.

Limitation of Liability

Visit Africa will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with these Terms, even if advised of the possibility of such damages. Our total liability to you will not exceed the total commissions paid or payable to you under these Terms.

Indemnification

You agree to indemnify and hold harmless Visit Africa, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your participation in the Affiliate Program or breach of these Terms.

Amendments

Visit Africa reserves the right to modify these Terms at any time. We will notify you of any changes by posting the revised Terms on our website or via email. Your continued participation in the Affiliate Program constitutes your acceptance of the modified Terms.

Governing Law

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Visit Africa is headquartered, without regard to its conflict of law principles.

Miscellaneous

1. Entire Agreement: These Terms constitute the entire agreement between you and Visit Africa regarding the Affiliate Program and supersede all prior agreements and understandings.
2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
3. Waiver: No waiver of any term or condition of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition.
